 Welcome to Octag AI By accessing or using Octag AI App, you agree to the following Terms of Service. Please read them carefully before using the app.

1. Acceptance of Terms

By creating an account or using Octag AI, you confirm that you have read, understood, and agree to these Terms of Service, along with our Privacy Policy. If you do not agree, you must not use the app.

2. Eligibility

You must be 18 years of age or older to use Octag AI. By using the app, you represent and warrant that you are legally capable of entering into this agreement.

3. User Responsibilities

You agree to use Octag AI responsibly and only for lawful purposes. Specifically, you agree: ✅ You may upload images or videos of yourself or other adults (18+). ✅ You may upload content featuring public persons (e.g., celebrities, influencers, public figures) for analysis, provided it complies with applicable laws. ❌ You may not upload graphic, pornographic, violent, or harmful content. ❌ You may not upload content involving minors (under 18 years old). ❌ You may not use the app to harass, stalk, or invade the privacy of others. Any violation of these rules may result in suspension or termination of your account.

4. Privacy & Data Use

Your uploaded media is analyzed securely and results are delivered privately to your in-app inbox. We do not sell or share your personal data with third parties. Content may be temporarily stored to generate results but will not be used outside the scope of the service. For full details, please review our Privacy Policy.

5. User Content and Intellectual Property Rights (Important Update)

• Your Ownership: You retain all ownership rights to the content (images, videos, etc.) you upload to the App.
• Your Responsibility: By uploading content, you represent and warrant that you own the content or have all necessary rights, licenses, consents, and permissions to submit it and to grant us the rights to use it as described in these Terms. You agree that you will not submit any content that is copyrighted or subject to third-party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner.
• License to Us: To allow us to provide the service, you grant Octag AI a limited, non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, process, and display the content you upload, solely for the purpose of operating, providing, and improving the App and its features. This license terminates when you delete your content or your account.

6. Copyright Infringement (DMCA Policy) (Important Update)

• We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to claims of copyright infringement committed using our service.
• If you are a copyright owner and believe that any content on our App infringes upon your copyrights, you may submit a notification by sending an email to hello@octagai.com with the subject line "DMCA Takedown Request" and all required information. Upon receipt of a valid notice, we will take whatever action we deem appropriate, including removal of the challenged material.

7. Subscriptions, Payments, and Billing 

Octag AI offers both auto-renewing subscriptions (e.g., "Pro Monthly") and consumable in-app purchases (e.g., "Token Packs").

• Auto-Renewing Subscriptions: Subscriptions will automatically renew for the same duration and price unless you cancel them. Payment will be charged to your Apple App Store account at the confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
• Cancellation: You can manage and cancel your subscriptions at any time by going to your account settings in the App Store after purchase. To avoid being charged for the next subscription period, you must cancel your subscription at least 24 hours before the end of the current period.
• Consumable Purchases: In-app purchases, such as token packs, are one-time purchases and are not subscriptions. They are consumed upon use.
• Refunds: All payments are handled by Apple through the App Store and are subject to Apple's terms and conditions. As such, all purchases are final and non-refundable, except as required by applicable law or as outlined in the App Store's policies.
• Price Changes: We reserve the right to change the price of subscriptions or other products. We will provide you with reasonable notice of any such pricing changes.

8. No Guarantee of Results 

Octag AI uses advanced AI technology, but we cannot guarantee results in every case. Outcomes depend on the clarity and quality of the uploaded media.

9. Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service, or
• Misuse the app in a way that harms others or our service.

10. Limitation of Liability

Octag AI is provided on an “as-is” basis. We are not responsible for inaccuracies in results or damages arising from misuse of the app. By using the app, you agree to hold us harmless from any claims, damages, or losses related to your content uploads or actions within the App.

11. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the app after updates constitutes acceptance of the revised terms.

12. Governing Law (Recommended Addition)

• These Terms of Service and any dispute arising out of your use of the App shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
